LIMITED WARRANTY
3M warrants to the original purchaser that 3M™ 6000 Series Half
Facepiece Respirators and their components are quality products
and will be free of defects in materials and workmanship and in
conformance with any express warranty for a specific purpose for
the first 90 days after delivery to the original purchaser and 3M’s
only obligation and your exclusive remedy shall be to repair, replace
or refund the purchase price of such parts or products upon timely
notification thereof and substantiation that the product has been stored,
maintained and used in accordance with 3M’s written instructions.
EXCLUSIONS TO WARRANTY: THIS WARRANTY IS
EXCLUSIVE AND IS IN LIEU OF ANY WARRANTY AND
CONDITION, EXPRESS OR IMPLIED, STATED OR
OTHERWISE, INCLUDING WARRANTIES OR CONDITIONS
OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE OR OTHER CONDITION OR WARRANTY OF
QUALITY, EXCEPTING WARRANTIES OR CONDITIONS
OF TITLE AND AGAINST PATENT INFRINGEMENT.
Limitation of Liability: Except as provided above, 3M shall in no
event be liable or responsible whether in contract or in tort or any
other legal theory for any injury, loss or damage, direct, indirect,
special, incidental or consequential, arising out of the use or misuse
or inability to use the equipment. 3M warranties and conditions as
herein above set forth shall not be enlarged, diminished or affected
by, and no obligation or liability shall arise or grow out of, the
rendering of technical advice or service by 3M or its agents. The
foregoing may not be changed except by written agreement signed
by an authorized officer of 3M. THE REMEDIES SET FORTH
HEREIN ARE EXCLUSIVE.
